Greenberg v Martin County

Stuart Shareholder Scott Konopka and attorney Erica Sadowski prevailed in an appeal of a code enforcement order halting construction of a home in Hobe Sound. The victory also reversed tens of thousands of dollars in fines against the owners. On appeal, the firm established that the County had fundamentally changed its interpretation and enforcement of a code provision defining a permanent foundation, after the County had issued a foundation permit to the clients. The court agreed that this conduct was improper and that the County acted without competent substantial evidence in halting construction of the home. Mr. Konopka commented, “This is a victory not only for our clients, but for all private property owners.” The court’s decision led to a settlement that fully compensated our clients and covered their legal fees and expenses.
