In April, 2012, after a non-jury trial, ​Mrachek Law’s client, Royal Palm Yacht and Country Club, was awarded a judgment for past due fees and charges owed by a resigned member and, more importantly, the member’s counterclaim for a return of 70% of his capital contribution was rejected by the court. If the court had granted the relief sought by the counterclaim, such judgment would have had an adverse precedential effect as to when the other members in the Club would be entitled to a return of a portion of their capital contribution.
