Construction Law
Mrachek Law advises a robust range of clients, including condominium associations, homeowners, developers and substantial general contractors, involved in construction matters. While Mrachek Law’s board certified construction law attorneys are capable of providing pre- and post-dispute advice, our primary focus is representing our clients in arbitration and litigation. We have represented condominium associations, commercial and residential land owners, developers and substantial general contractors in disputes involving construction defects and related issues from inception through trial or final evidentiary hearing (and appeal). We have also advised clients on negotiation and drafting of construction contracts, compliance with construction codes and regulations, investigations of construction defects pursuant to Fla. Stat. Ch. 558, and how to investigate and handle engineering and design defects, building code violations, product failure, warranty claims, and breach of contract claims. Our practice traditionally has concentrated on the representation of owners of single family residences, commercial buildings, homeowner associations, and condominium associations. Shareholder Dan Thomas and Associate Rich Cartlidge lead our Construction Law team, both of whom are Board Certified by the Florida Bar in Construction Law. Dan was named the 2022 Lawyer of the Year, West Palm Beach, in Construction Law and Litigation – Construction in the Best Lawyers Business Edition. He has also been a guest lecturer at the University of Florida’s College of Design, Construction and Planning, and consistently been named to all of Florida’s highest construction law honors.
The Firm’s construction law team is scalable depending on the dispute, and employs other shareholders and associates depending on the issue to be addressed. Commonly, Greg Weiss, who is Board Certified by the Florida Bar in both Civil Trial and Business Litigation, becomes involved early in construction disputes that will be presented at trial (or an arbitration’s final evidentiary hearing), in order to develop the right theme and theory, and requisite evidence, to present to the finder of fact. Alan Rose, who is Board Certified by the Florida Bar in both Appellate Practice and Business Litigation, becomes involved in all jury trial matters to create a defensible record for appeal, and Manny Farach, who is Board Certified by the Florida Bar in Real Property, Appellate Practice and Business Litigation, becomes involved in matters where real property issues underlie the construction issues. Our team employs a multi-faceted approach to litigation and arbitration, and focuses on delivering superior results in the most expedient and cost-effective manner.
Mrachek Law is a leader in owner/association representation. While many firms focus on representing contractor and trades pursuant to insurance coverage, Mrachek Law does not work for insurance companies. From your first meeting with us until the conclusion of your matter, you will be provided with personal service; accessible team members; and multidisciplinary team depth. Our firm will work cooperatively with your existing legal team, and assemble, as needed, a team of experts to properly document the claims and damages, working with everyone in person throughout the process.
Representative matters
Condominium Turnover– We secured a significant multi-million dollar recovery on behalf of a large condominium association. Our team assembled a team of experts to properly evaluate the property, and ensured that all of the defects were known to the board of directors so that they could properly negotiate the claims on behalf of their owners. As part of our engagement evaluated multiple insurance policies, and presented a damages model that implicated multiple policies to maximize the recovery.
Chinese Drywall– We represented the developer of a 320-unit condominium that was built with defective Chinese-manufactured drywall. As lead trial counsel we helped secure a $24M renovation of the project.
Single Family Residences– We represent numerous high net worth individuals in the prosecution of construction defect claims arising from new construction and renovations, from Palm Beach to Vero Beach.
Our Construction Law Team includes two of only 418 attorneys who are Board Certified in Construction Law by The Florida Bar Board. Our team works closely with a team of tightly integrated legal, insurance, engineering, architecture and construction experts across Florida, and will act quickly to bring disputes to resolution.
