Mrachek Law Shareholders, Lou Mrachek and Roy Fitzgerald, and Associate, Jessica Haffkoss, prevailed on behalf of their client, after more than six years of litigation and four weeks of trial in the 17th Judicial Circuit’s Complex Litigation Division in Fort Lauderdale. As the Court described it in the first sentence of the Final Judgment, “[the] Court managed six years of acrimonious litigation which culminated in almost (123) hours of trial testimony between April 4 – 28, 2022.”
Mrachek Law represented several defendants including LGL Recycling and certain of its principals, against a multi-count claim brought by Bergeron Environmental & Recycling. LGL had been in a joint venture with Bergeron, before selling its assets to Waste Management, one of the other defendants. Bergeron claimed more than $70,000,000 in damages, for breaches of contract, tortious interference with a business relationship and other theories. The trial judge found completely in favor of the defendants, awarding Bergeron no damages.
Mrachek said, “We are thrilled for our client to finally have its day in court, and now be free of the specter of this lawsuit.” The Complaint consisted of 123 pages, 14 causes of action, and 37 exhibits, for a total 1,288 pages. The litigation raged over several years, with lengthy fights over discovery of electronically stored information, evidentiary hearings on the crime-fraud exception to the attorney-client privilege, and even two attempts to add antitrust counts.
Mrachek and Fitzgerald are members of the American College of Trial Lawyers, and both are Board Certified by the Florida Bar in Business Litigation. Fitzgerald said, “We developed our trial plan early, but the importance of the outcome to our client in light of the claimed damages made this our client’s Battle of Hastings. Nonetheless, our client always remained focused on having its day in court to achieve vindication.”
