Scott Konopka and Paige Gillman obtained a favorable settlement in a trademark litigation in which Mrachek Law filed a FDUTPA counterclaim alleging that the clients’ license agreement was a disguised franchise agreement. By focusing on a statutory basis to invalidate the license agreement, and using federal and state precedent in support, the case was settled without protracted litigation.
